深圳前海聯(lián)合交易中心有限公司（在本隱私政策聲明中，稱為“交易中心”或“我們”，視適用情況而定）明白根據(jù)《中華人民共和國(guó)民法典》、《中華人民共和國(guó)網(wǎng)絡(luò)安全法》、《中華人民共和國(guó)個(gè)人信息保護(hù)法》等法律法規(guī)（以下簡(jiǎn)稱“個(gè)人信息保護(hù)相關(guān)法律法規(guī)”）其在收集、持有、處理、使用及／或轉(zhuǎn)移個(gè)人信息方面的責(zé)任。

本隱私政策聲明適用于交易中心網(wǎng)站、交易中心系統(tǒng)、交易中心微信公眾號(hào)。本隱私政策聲明如有任何修訂，我們會(huì)通過(guò)交易中心網(wǎng)站或系統(tǒng)等渠道公布。經(jīng)更新的版本一經(jīng)公布即告生效并取代當(dāng)前版本。如果我們對(duì)本隱私政策聲明作出重大變更（例如業(yè)務(wù)功能變更、個(gè)人信息出境情況變更、使用目的變更），我們將以更為顯著的方式（包括但不限于瀏覽頁(yè)面特別提示等）通知您。無(wú)論我們是否向您發(fā)送具體通知，您應(yīng)不時(shí)關(guān)注個(gè)人信息收集和使用的相關(guān)公告、提示信息及協(xié)議、規(guī)則或其他相關(guān)內(nèi)容的變動(dòng)。您知悉并確認(rèn)，如您不同意更新后的內(nèi)容，應(yīng)立即停止使用相應(yīng)服務(wù)，并注銷相關(guān)的用戶賬號(hào)，我們將停止收集您的相關(guān)信息。

交易中心網(wǎng)站、交易中心系統(tǒng)及交易中心微信公眾號(hào)的用戶為已滿十八周歲的成年人，但是由于技術(shù)限制，在某些情況下，我們無(wú)法識(shí)別用戶的年齡。若您未達(dá)到上述年齡要求，請(qǐng)不要使用交易中心網(wǎng)站或系統(tǒng)并輸入您的個(gè)人信息。

- 您主動(dòng)提供的信息

- 向第三方共享個(gè)人信息的情況

為了實(shí)現(xiàn)本隱私政策所述的目的，您的個(gè)人信息可能會(huì)提供給下列各方：

為上述目的，您同意將您的個(gè)人信息轉(zhuǎn)移到位于中國(guó)大陸境外的一方。

- 為遵守法律與法規(guī)而披露您的個(gè)人信息。

交易中心及香港交易所集團(tuán)的其他成員為了遵守適用法律及法規(guī)，或遵守法院指令、傳票或其他法定程序（無(wú)論于中國(guó)或其他地方），或遵從政府機(jī)關(guān)、執(zhí)法機(jī)構(gòu)或類似機(jī)構(gòu)（無(wú)論位于中國(guó)或其他地方）提出的要求，又或履行我們作為受監(jiān)管的交易平臺(tái)的義務(wù)，可保留、處理及／或披露您的個(gè)人信息。交易中心及香港交易所集團(tuán)的其他成員或須披露您的個(gè)人信息，以履行與您的協(xié)議，或保護(hù)我們或我們雇員的權(quán)利、財(cái)產(chǎn)或安全，又或執(zhí)行或履行管理職能。

- 公司重組

隨著我們持續(xù)發(fā)展業(yè)務(wù)，我們可能會(huì)重組公司架構(gòu)或出現(xiàn)控制權(quán)易手或業(yè)務(wù)合并。在這些情況下，在符合法律法規(guī)規(guī)定的前提下，您的個(gè)人信息或會(huì)按本隱私政策聲明移交繼續(xù)運(yùn)營(yíng)我們業(yè)務(wù)或類似服務(wù)的第三方。此等第三方或在中國(guó)以外的地方，就此等收購(gòu)或重組而使用您個(gè)人信息的地點(diǎn)也可能不在中國(guó)。

如果您注銷了我們的賬戶或與我們的關(guān)系被取消或終止或根據(jù)個(gè)人信息保護(hù)相關(guān)法律法規(guī)的規(guī)定，您可以通過(guò)交易中心網(wǎng)站或系統(tǒng)，或以書面及郵遞形式等渠道（見(jiàn)以下“聯(lián)系我們”）向我們提出刪除個(gè)人信息的請(qǐng)求。我們會(huì)隨即在合理情況下盡快刪除或終止處理您的個(gè)人信息，但也可按合理需要而保留有關(guān)信息，合理的需要包括：信息歸檔；解決實(shí)際或潛在的爭(zhēng)議；遵守適用法律法規(guī)規(guī)定，或按政府主管部門的強(qiáng)制性要求；履行與您的任何協(xié)議以及執(zhí)行或履行我們的法定職能、義務(wù)及責(zé)任等。

- 撤回同意

根據(jù)中國(guó)相關(guān)的法律法規(guī)和監(jiān)管規(guī)定，您有權(quán)撤回您的同意。您可以通過(guò)關(guān)閉我們對(duì)您設(shè)備的訪問(wèn)權(quán)限，或通過(guò)交易中心網(wǎng)站或系統(tǒng)，或以書面及郵遞形式等渠道（見(jiàn)以下“聯(lián)系我們”）撤回您的同意。撤回同意后，我們將不再收集和處理您的個(gè)人信息，但法律法規(guī)和本隱私政策聲明另有規(guī)定的除外。

請(qǐng)您注意，您撤回同意，不會(huì)影響此前我們基于您的同意而開(kāi)展的個(gè)人信息的收集和處理。

- 限制或拒絕處理您的個(gè)人信息

您有權(quán)限制或者拒絕他人對(duì)您個(gè)人信息進(jìn)行處理，我們將按照適用法律的規(guī)定為您提供限制或拒絕的途徑，請(qǐng)根據(jù)上述相同方式與我們聯(lián)絡(luò)。

- 響應(yīng)您的請(qǐng)求

您請(qǐng)求行使享有的個(gè)人信息主體權(quán)利或要求我們對(duì)我們個(gè)人信息處理活動(dòng)的規(guī)則進(jìn)行解釋說(shuō)明，可以通過(guò)以下“聯(lián)系我們”提供的聯(lián)系方式向我們提出請(qǐng)求。我們將盡合理的努力及時(shí)滿足您的請(qǐng)求，我們將在收到您的請(qǐng)求并完成對(duì)您的身份驗(yàn)證后在適用的法律法規(guī)要求的時(shí)限內(nèi)（通常不超過(guò)15個(gè)工作日內(nèi)）回復(fù)您的請(qǐng)求。

我們通過(guò)自動(dòng)化技術(shù)獲取的您的信息

（1）我們?nèi)绾问褂胏ookies

您通過(guò)交易中心網(wǎng)站或系統(tǒng)訪問(wèn)或使用我們的信息或服務(wù)時(shí)，應(yīng)當(dāng)留意到網(wǎng)站或系統(tǒng)使用cookies。Cookies指儲(chǔ)存在您瀏覽器內(nèi)的數(shù)據(jù)文件。您訪問(wèn)交易中心網(wǎng)站或系統(tǒng)時(shí)，網(wǎng)站或系統(tǒng)即在您瀏覽器內(nèi)自動(dòng)安裝并使用cookies。交易中心網(wǎng)站或系統(tǒng)使用兩種cookies：

• Session Cookies：一種只在您瀏覽交易中心網(wǎng)站或系統(tǒng)期間留存于瀏覽器內(nèi)的短暫性質(zhì)cookies，用處在取得并儲(chǔ)存配置信息及管理網(wǎng)站或系統(tǒng)，包括“攜帶”信息以隨您瀏覽網(wǎng)站或系統(tǒng)的不同網(wǎng)頁(yè)，譬如以免您每到一個(gè)網(wǎng)頁(yè)均要重新輸入信息。Session cookies也會(huì)用來(lái)編制關(guān)于交易中心使用情況的匿名統(tǒng)計(jì)資料。
• Persistent Cookies：一種留存于瀏覽器內(nèi)較長(zhǎng)時(shí)間的cookies，用以編制關(guān)于交易中心網(wǎng)站或系統(tǒng)使用情況的匿名統(tǒng)計(jì)資料，或追蹤和記錄用戶的偏好。

交易中心網(wǎng)站或系統(tǒng)所用的cookies不包含個(gè)人信息。您可以更改瀏覽器或網(wǎng)路安全軟件中的設(shè)置，拒絕接受瀏覽器內(nèi)的cookies。不過(guò)，這樣或會(huì)令您不能使用或啟動(dòng)交易中心網(wǎng)站或系統(tǒng)中的某些功能。

（2）為了向您提供我們的產(chǎn)品和服務(wù)，我們還可能通過(guò)cookies、web beacon或其他方式在您使用交易中心網(wǎng)站或系統(tǒng)時(shí)自動(dòng)收集下列信息：

Privacy Policy Statement

Shenzhen Qianhai Mercantile Exchange Co., Ltd. (深圳前海聯(lián)合交易中心有限公司) (referred to as “QME”, “we”, “our” or “us” in this Privacy Policy Statement, as applicable) understands the responsibilities in relation to the collection, holding, processing, use and/or transfer of personal data under the “Civil Code of the People’s Republic of China”, the “Cybersecurity Law of the People’s Republic of China”, the “Personal Information Protection Law of the People’s Republic of China” and other applicable laws and regulations (together, “Applicable Personal Data Protection Laws and Regulations”).

This Privacy Policy Statement applies to the QME website, QME system and QME WeChat official account. Any amendments to this Privacy Policy Statement will be published via the QME website or system etc. The updated version of the Privacy Policy Statement will take effect and replace the current version once published. If we make any major changes to this Privacy Policy Statement (e.g., changes to business functions, changes to cross-border transfer of personal data, changes to use of personal data), we will notify you in a prominent manner (including but not limited to posting a special notice on our website etc.). Regardless of whether we give you specific notice, you should regularly review our notices in relation to the collection and use of personal data, notification messages and agreements, rules and other related changes to any relevant content. You acknowledge and understand that, if you disagree with the updated content, you must immediately cease using the relevant services and cancel your user account and we will cease the collection of your relevant information.

We will use your personal data collected in accordance with this Privacy Policy Statement from time to time.

We will regularly review this Privacy Policy Statement and, for example, supplement with specific instructions, policies and terms.

Users of the QME website, QME system and QME WeChat official account shall be adults over eighteen (18) years of age. However, due to technical limitations, in certain circumstances, we are unable to verify the age of users. If you do not meet the age requirement set out above, please do not use the QME website or system nor submit any of your personal data.

What personal data do we collect and how do we collect it?

• Data directly submitted by or collected from you

If you do not wish to receive our promotional or direct marketing materials, or you do not wish to receive certain categories of promotional materials or direct marketing materials, or you do not wish to receive such materials through certain channels, please contact us in accordance with the “Contact Us” section below. To ensure that we can promptly process your request, please provide your full name, email address, login name, and details of the products and/or services which you have subscribed to.

How do we process, share or transfer your personal data?

• Sharing with our affiliates for direct marketing

  Subject to obtaining your consent, we will disclose your name, mailing address, phone number and email address to the Hong Kong Exchanges and Clearing Limited and its affiliated companies (together, “HKEX Group”) so that HKEX Group may deliver to you promotional materials, or conduct direct marketing activities in relation to HKEX’s financial and information services.

• Sharing personal data with third parties

  In order to fulfil the purposes set out in this Privacy Policy Statement, your personal data may be disclosed to the following third parties:

  1. HKEX Group (in Hong Kong or otherwise). Please click here for a list and further details of HKEX Group and its affiliated companies;

  2. Agents, contractors or third party service providers who provide administrative, telecommunications, IT, payment, debt collection, information processing or other services to any member of HKEX Group in Hong Kong or elsewhere;

  3. Other persons (subject to obtaining your separate consent at the time of data collection);

  4. Subject to obtaining your consent, we may share your personal data (e.g., name, mobile phone number) with third parties related to the provision of our products and services (e.g., banks, warehouses). Please click here for a list and further details of such third parties;

  5. We may disclose your personal data to government agencies, regulatory authorities, and law enforcement agencies in accordance with applicable laws and regulations, or upon the mandatory request of a competent government authority.

  To achieve the above purposes, you consent to the transfer of your personal data outside of Mainland China.

• Disclosing your personal data for compliance with laws and regulations.

  QME and other members of HKEX Group may keep, process, and/or disclose your personal data for compliance with applicable laws and regulations, or for compliance with court orders, summons or other legal processes (whether in China or otherwise), or for compliance with requests from government agencies, law enforcement agencies or other similar agencies (whether located in China or otherwise), or to fulfill our obligations as a regulated exchange. QME and other members of HKEX Group may need to disclose your personal data to perform our obligations under the agreement(s) with you, or to protect us or our employees’ rights, property or safety, or to carry out or perform our administrative functions.

• Company Restructuring

  As we continue to develop our business, we may restructure our organisational structure or there may be a change of control or we may merge our business. In these circumstances, and subject to compliance with laws and regulations, your personal data may, in accordance with this Privacy Policy Statement, be transferred to third parties who continue to operate our business or provide similar services. These third parties may be located outside of China, and your personal data may be used outside of China for the purposes of such acquisition or restructuring.

How we store and transfer your personal data

We will store your personal data on servers located in Mainland China. We will retain your personal data for as long as necessary to fulfill the purposes of our processing, unless applicable laws require a longer retention period. Upon expiration of the retention period, your personal data will be deleted or anonymised. However, for the purposes of managing our global business and to improve our services, we will transfer your personal data outside China (for a list and further details of HKEX Group and its affiliated companies, please see the “Sharing personal data with third parties” section above). We will carry out all necessary procedures in accordance with laws and take all necessary measures to ensure that the data recipients meet the protection standards required by applicable laws and regulations.

How we protect your personal data

We will take all practicable measures to ensure the security of personal data, and prevent unauthorised or accidental access, deletion or other use of personal data.

However, you should be aware that, due to the open nature of the Internet, we cannot guarantee absolute security. We will continuously implement and update our management, technical, and physical security measures to ensure that your data is protected from unauthorised access, loss, destruction or alteration.
